AGREEMENT TO CONTEST RULES AND TERMS
All contests are overseen, hosted and prizes (where applicable) are awarded by My Spot.
These Contest Rules and Terms constitute a legally binding agreement made between you, whether personally or on behalf of the person of whom is submitting the content into the contest (“you”) and My Spot ("Company", “we”, “us”, or “our”), concerning your access to and use of the app as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Contest Rules. IF YOU DO NOT AGREE WITH ALL OF THESE CONTESTS RULES, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
These rules apply to all past, current and future contests on our platform.
Purchases
No purchase is necessary to enter any of our contests. Only one entry allowed per account holder.
Who Can Enter
To be eligible to participate in contests, entrants must be residents of the contests location based terms
Entrants must have an account with My Spot
Entrants must be at least 18 years of age or older
Entrants ARE NOT ABLE to enter if they are affiliated with My Spot or the partner in any way shape or form. This also includes “immediate family” members such as spouses, grandparents, parents, siblings, children and grandchildren
Restrictions/Disqualifications
Entrants may be disqualified if they violate one or more of the terms listed below…
Violation of our Terms of Service and/or the hosting companies (if applicable)
Entrant creates and/or uses more than one account to enter into a single contest
Entrant is under the age listed above
Entrant does not have a My Spot account
Entrant is affiliated with My Spot or the hosting company in any way shape or form
Entrant uses another form of entry to “boost” their chance of getting selected
Entrants submitted work is not a work of their own
Entrant is not a resident within the listed location boundaries for that contest
Entrant does not comply with the rules/policies that have been set by My Spot and/or the hosting company
Works Submitted Rules
ALL submitted work must be the users own work
No mechanically reproduced or completed entries will be accepted.
By entering, entrants represent and warrant (i) that they own the picture submitted, and (ii) it does not violate the rights of any third parties. No lewd, nude, crude, or offensive photographs (as determined by My Spot or the host company in its sole and absolute discretion) will be accepted. My Spot and the host company reserves the right in its sole and absolute discretion to disqualify any entry.
The contest starts on the date the contest is available for entries, and all entries must be received by the end date given for each contest on the contests details page. My Spot is not responsible for lost, late, or misdirected entries, printing errors, server unavailability, computer, or any other electronic malfunction.
On the date given for each contest on the contests details page, one (1) winner will be selected by My Spot/the hosting company from among valid entries. Remaining valid entries will not carry over to another contest.
Prize(s)
One (1) winner will be selected. That winner will receive the prize shown on the contests details page.
Each winner will be notified by email and if applicable sent a notification on My Spot. Before claiming the prize, the winner must provide his/her correct name and other information needed to get the prize to that user such as their address, at the time of notification. Each winner must sign and return a release and affidavit of eligibility (if applicable), which must be received within fourteen (14) days of notification, at that time the winner claims their prize. If a winner is a minor, then the winner’s parents or guardian must sign a release and affidavit of eligibility before the winner receives his or her prize. Each winner must show picture identification to claim prizes. My Spot reserves the right to examine additional identification and may choose to accept or deny awarding the prize based on the identification presented.
If a winner cannot be notified within fourteen (14) days, or does not timely sign and return the release and affidavit of eligibility (if applicable), then the prize will be forfeited, and the prize will be awarded to the runner up.
There will be no substitutions or cash alternatives for any prize except at the sole discretion of My Spot and/or the hosting company. My Spot has the right to substitute a prize of similar value. No transfer or assignment of prizes is allowed.
Each winner is responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules. If the amount is high enough the winner must complete and sign a Form W-9.
Only one prize will be awarded per household.
My Spot is not liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize.
My Spot is not responsible for any liability arising directly or indirectly from the award or use of the prize.
In claiming your prize, you acknowledge that My Spot and/or the hosting company has the right to publicize your name and the fact that you are the winner for promotional purposes without financial remuneration.
Odds of Winning/Miscellaneous
1. Odds of winning depend on the number of valid entries received.
2. Complete contest rules are available on this page 24/7.
3. This contest is subject to all applicable laws and regulations and is void where prohibited. My Spot and the hosting company accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.
4. My Spot/the hosting company cannot be held liable for any lost or stolen entries, prizes, or contest information. My Spot/the hosting company is not responsible for any computer or electronic malfunction, server unavailability, technological glitch, or human error relating to this contest and/or the use of short-code.
5. My Spot/the hosting company reserves the right to make rules and contest changes, and change the aforementioned contest dates.
6. By entering this contest, each entrant waives any and all claims of liability against My Spot, www.hellomyspot.com, and their respective parents, affiliates, officers, directors, employees and agents, for any and all claims, loss, damage or injury which may occur as a result of entrant’s participation in this contest.
